El mecanismo de salvaguardia global

    Ante el peligro que enfrentan sectores productores de mercancías sobre los efectos de la apertura comercial, han sido creados mecanismos temporales de protección que permiten que estos tomen medidas que permitan aumentar su competitividad y enfrentar las importaciones de productos extranjeros. Dentro de estos procesos, de carácter extraordinario, se encuentran las salvaguardias, siendo uno de sus tipos la denominada “global”, que es regulada en el marco multilateral de la Organización Mundial del Comercio (OMC).

    En el proceso debe demostrarse el incremento de importaciones en un período dado, la existencia de daño o amenaza de daño para la producción nacional, y que hay un nexo causal entre ambos aspectos. Si esto llega a probarse, el Estado autorizará el incremento de aranceles (impuestos a la importación), lo cual hará más costoso el ingreso de mercancías extranjeras competidoras.

    Before the possible negative effects of trade openings that productive sectors might have to endure, there are some temporary protective mechanisms that allow them to acquire adjustment measures to increase their competitiveness to be able to face the imports of foreign products. Among those mechanisms that shall be considered as an exception, are safeguards. There are different type of safeguards, including a “global safeguard” which is regulated in the multilateral framework of the World Trade Organization (WTO).

    To activate the global safeguard, it is necessary for the party trying to apply it to demonstrate an increase of imports in a determined period of time, the existence of damage or the threat of a severe damage to the national production of the similar or same product which is being imported, and that there is a causal link between both aspects. If all three elements mentioned are proven, the Government can authorize an increase in the tariffs applied to the products subject of investigation. The effect would be an increase in the final price of the imported competitor goods, allowing national industry to adapt to competition.
