El autor examina la sentencia dictada por la Corte Suprema, que rechaza recurso de unificación de jurisprudencia en torno al artículo 45 del Código del Trabajo, disposición que consagra el beneficio de la semana corrida. Frente a las distintas interpretaciones relativas a la situación del trabajador sujeto a sueldo mensual y remuneración variable, el máximo tribunal sostiene que este percibirá semana corrida únicamente si los estipendios variables se devengan diariamente. El autor comenta dicha interpretación y el voto en contra.
The author examines the sentence issued by the Supreme Court, which rejects an appeal for unification of jurisprudence regarding Article 45 of the Labor Code, a provision that establishes the benefit of the uninterrupted week. Facing with the different interpretations regarding the situation of the worker subjected to monthly salary and variable remuneration, the highest court argues that he will receive an uninterrupted week only if the variable stipends are accrued daily. The author comments on that interpretation and the vote against it.
