    Este trabajo se estructura en dos parte diferenciadas. En la primera se analizan, como presupuesto conceptual necesario, los diferentes modelos de Poder Judicial y de gobierno de los jueces en el constitucionalismo contemporáneo, puesto que entender cabalmente la posición constitucional del Poder Judicial y de la Administración de Justicia exige esa primera aproximación. En la segunda parte se pretende analizar el encuadre de este problema, Poder Judicial y Administración de Justicia, en el sistema constitucional de 1978 y en la evolución del modelo judicial desde la LOPJ de 1985 hasta nuestros días, poniendo el acento especialmente en lo que afecta a la organización territorial del Estado. El Poder Judicial y la Administración de Justicia se han organizado constitucionalmente el clave centralista, con una apertura gradual a las Comunidades Autónomas en lo que afecta al modelo de gestión, si bien solo parcialmente. En este estudio se analizan las dificultades del proceso y se concluye con la complejidad que implica, en el actual contexto normativo y político-institucional, su evolución hacia una impregnación mayor del poder judicial en clave territorial.

    Lan hau bi zatitan egituratu da. Lehenengoan, beharrezko premisa kontzeptual gisa, gaur egungo konstituzionalismoko epaileen botere judizialaren eta gobernatzekoaren ereduak analizatzen dira. Izan ere, botere judizialaren eta Justizia Administrazioaren jarrera konstituzionala ulertu ahal izateko, ezinbestekoa da lehen hurbilketa hori egitea. Bigarren zatian, arazo hori –botere judiziala eta Justizia Administrazioa– 1978ko sistema konstituzionalean eta 1985eko BJLOtik gaur egunera arteko eredu judizialaren eboluzioan nola kokatzen den aztertu nahi da, Estatuaren lurralde-antolaketari arreta berezia jarrita. Botere judiziala eta Justizia Administrazioa, Konstituzioari dagokionez, era zentralistan antolatu dira, autonomia-erkidegoetara modu gradualean irekita kudeaketa-ereduari dagokionez, eta partzialki baino ez. Azterlan honetan prozesuaren zailtasunak aztertzen dira, eta, amaitzeko, egungo testuinguru normatibo eta politiko-instituzionalean, prozesuak botere judiziala lurraldeari dagokionez gehiago inpregnatzeko bilakaera hartzeak dakarren konplexutasuna jorratzen du.

    This piece is divided into two different parts. In the first part, the different models of the Judiciary and of the rule of judges in contemporary constitutionalism are analysed, as that initial approach is required in order to fully understand the constitutional position of the Judiciary and the Justice Administration. The second part aims to analyse how the Judiciary and Justice Administration question fits into the 1978 constitutional system and into the evolution of the judicial model from the Organic Law of the Judiciary of 1985 to the present day – placing special emphasis on the regional organisation of the State. The Judiciary and Justice Administration have been constitutionally organised in a centralist way, with a gradual opening to the Autonomous Communities in terms of their model for management – although only partially. In this study, the difficulties of the process are analysed. The conclusion discusses the complexity implied, within the current legal and political/institutional context, by a greater expansion of the Judiciary at the regional level.
