    Más allá de definir un listado o elenco de competencias resulta fundamental determinar los mecanismos e instrumentos que garanticen y blinden el ejercicio efectivo de las mismas. El nuevo Estatuto debería garantizar que las competencias que ejerzan las instituciones vascas queden protegidas y debería apostar por la bilateralidad. El texto estatutario debería arbitrar un sistema de garantías que asegure una bilateralidad de tipo confederal en las relaciones entre el Estado español y el sujeto jurídico político basado en la cooperación.

    Eskumen-zerrenda bat definitzetik haratago, ezinbestekoa da horiek eraginkortasunez erabiltzea bermatuko duten mekanismoak eta tresnak zehaztea. Estatutu berriak euskal erakundeen eskumenak babestuta egotea bermatu beharko luke eta aldebikotasunaren aldeko apustua egin beharko luke. Estatutu-testuak berme-sistema bat arbitratu beharko luke, lankidetzan oinarritutako aldebikotasun konfederal bat ziurtatu ahal izateko Espainiako Estatuaren eta subjektu juridiko -politikoaren arteko harremanetan.

    In addition to defining a list – or roster – of powers, it is essential to determine the mechanisms and instruments that ensure and shield the effective exercise of said powers. The new Basque Statute must ensure that the powers exercised by Basque institutions are protected, and it must support bilateralism. The text of the statute must mediate a system of guarantees that ensures a certain bilateralism of a confederate nature in the relations between the Spanish State and the legal/political subject – and this system should be based on cooperation.
