  En este artículo apuntaré una posible línea de investigación sobre la historia y teoría del precedente vinculante, uno de los aspectos centrales del rule of law en países de la familia angloamericana. Entre otras cosas describiré cómo, aunque esta doctrina tiene unos orígenes relativamente recientes, la idea de precedente puede remontarse a la propia formación del common law. También hablaré brevemente de la aparición de la moderna doctrina del precedente y qué relación guarda con el desarrollo medieval anterior. Este marco me servirá para encuadrar y esbozar qué posible línea de investigación se pueden abrir.

  In this article, I will propose a line of research about the theory and history of the doctrine of precedent, one of the crucial elements of the rule of law of the Anglo-American legal family. Among other things, I will show how the idea of precedent goes back to the formative period of the common law. I will also discuss the emergence of the modern doctrine of precedent as well as how is related to its medieval development. Upon this framework, I will discuss my proposed line of research.
