Rotulagem de transgênicos no Brasil: o retrocesso do PL n° 4.181/08

    Tramita no Senado Federal o Projeto de Lei n° 4.148/08, do Deputado Luiz Carlos Heinz, que pretende alterar o sistema de rotulagem de transgênicos no Brasil. Atualmente, a Lei de Biossegurança, que abriga questões alimentares e ambientais junto com o princípio da informação que rege o Direito do Consumidor, determina que qualquer produto com mais de 1% (um por cento) de transgênico em sua composição apresente as respectivas informações em seu rótulo. Se aprovado o Projeto, a rotulagem demandará, antes, estudo que detecte a incidência e a proporção de organismos geneticamente modificados, bem como retirará das embalagens o símbolo característico dos transgênicos. Este artigo apresenta as questões que envolvem os alimentos transgênicos no Brasil, bem como o tratamento legal referente à rotulagem, segurança alimentar e meio ambiente, para, ao final, demonstrar o retrocesso jurídico e funcional que reside no PL n° 4.148/08.

    The Senate is currently debating the Bill No. 4,148/08, proposed by the Deputy Luiz Carlos Heinz, which wants to change the way transgenic food is labeled in Brazil. Nowadays, the Biosafety Law, that states about environmental preservation and food security, and agrees with the principle of consumer information, provides that any product containing more than 1% (one per cent) of GMO in its composition must present the information on the label. By the Bill, this information will only be labeled if a preliminary research to detect the incidence and rate of genetically modified organism is made. Besides that, the Bill states that labeled GMO will not demand the transgenic symbol printed with the other information. This article shows how transgenics are seen in Brazil by environmental, food and label laws. In the end, it demonstrates the legal and practical setback that may come with the Bill No. 4,148/08.
