The present article seeks to develop the idea of prescriptibility of the claim of compensation of the public treasury from a distinctive hermeneutic of the article 37, § 5º present at the Federal Constitution, bearing in mind recent decision of the Extraordinary Appeal 669.069/MG in the Plenary of the Supreme Federal Court. For this purpose, based on a few raised arguments during the plenary meeting, it is built an analysis of the institution of prescription and its innate relation with the principle of legal certainty. After that, the traditional argument of the public interest is deconstructed, in the search of balancing it with the discipline of the fundamental rights. Lastly, it is shown different currents interpretation present in the doctrine, in order to provide a debate on the most appropriate interpretation to be granted to the subject in question.
O presente artigo procura desenvolver a ideia da prescritibilidade das pretensões de ressarcimento ao erário a partir de uma hermenêutica diferenciada do artigo 37, § 5º, presente na Constituição Federal, tendo em vista recente julgamento do Recurso Extraordinário 669.069/MG no Plenário do Supremo Tribunal Federal. Para tanto, parte de alguns dos argumentos levantados durante a sessão, construindo uma análise sobre o instituto da prescrição e sua intrínseca relação com o princípio da segurança jurídica. Em seguida, desconstrói o tradicional argumento do interesse público, buscando equilibrá-lo com a disciplina dos direitos fundamentais. Por fim, apresentam-se diferentes correntes de interpretação presentes na doutrina como forma de propiciar um debate sobre a interpretação mais adequada a ser conferida ao dispositivo em comento.
