    One of the painful problems of the current world reality is the situation of Syrian refugees, many of whom choose Europe as a destination. This migratory process is the result of a violent civil war, which devastates the population of Syria over the last six years. The Syrian conflict is part of an international scenario where geopolitical relations no longer behave as they were in the beginning of the process of globalization and human rights seek to survive as an essential instrument for maintaining civility. Thus, this study had as objective to analyze the questions around the migratory flow, in the light of the Theory of Justice of John Rawls, whose proposal alerts to the traps of the utilitarianism and preaches the cooperation between the human beings. As a response to the proposed comparison, it was observed the difficulty in extending the idea of justice, in the manner thought by Rawls, to the tension addressed, since the power of fraternity is precisely made.

    Um dos dolorosos problemas da realidade mundial vigente é a situação dos refugiados sírios, muitos dos quais escolhem a Europa como destino. Referido processo migratório é fruto de uma violenta guerra civil, que há seis anos arrasa a população da Síria. O conflito sírio insere-se num cenário internacional onde as relações geopolíticas não mais se comportam como nos primórdios do processo de mundialização e os Direitos Humanos procuram sobreviver como instrumento imprescindível à manutenção da civilidade. Assim, o estudo em tela teve como objetivo analisar as questões em torno do fluxo migratório, à luz da Teoria da Justiça de John Rawls, cuja proposta alerta para as armadilhas do utilitarismo e prega a cooperação entre os seres humanos. Como resposta ao cotejamento proposto, observou-se a dificuldade em se estender a ideia de justiça, nos moldes pensados por Rawls, à tensão abordada, pois parco se faz, justamente, o poder da fraternidade.
