    Nuestro actual proyecto de investigación, se propone analizar interdisciplinariamente la incorporación a la dimensión normológica jurídica del fenómeno sociológico “gestación por sustitución”, conforme el Proyecto de Código Civil y Comercial (2012) argentino y desde la Bioética dilucidar si hay un derecho absoluto a la procreación en tensión con el interés superior del niño. Asimismo, evaluar las posibles implicancias que esta nueva modalidad de formar una familia aparejen para la sociedad argentina, conforme la plataforma histórica en la que surge y los valores en juego.

    This investigation project tends to analyze, in an interdisciplinary way, the incursion of the sociologic phenomenon “creation by substitution”, into a mormologic dimension of law according to the Argentinian Civil and Commercial Code project (2012). From the perspective of Bioethics, this paper is intended to clarify whether or not there is an absolute right to procreation fighting against the superior interest of the child. Likewise, this project of investigation seeks to evaluate the possible implications of this new way to conform a family into the Argentinian society, in obedience to the historic platform where it took place and de moral values at stake.
