O conteúdo do direito à liberdade de expressão, o discurso de ódio e a resposta democrática

    This text advocates that the analysis of the international instruments governing the right to freedom of expression and its restrictions distract the best defenses of the ban from the restriction imposed on the hate speech. To this end, it establishes the genesis of the protection of freedom of expression and assesses how the universal and the inter-American and European regional instruments contemplate it, clarifying its content and the restrictions that are imposed on its exercise. The research was carried out on doctrine and on the mentioned international instruments. The analysis led to the conclusion that the Inter-American system is the most protective of freedom of expression, while at the same time being more modest in relation to the restrictions it imposes on the exercise of freedom of expression. Even so, there is a mechanism in the inter-American system that allows adequate protection against abuses that may be practiced in the name of freedom of expression and that justifies the adoption of restrictions such as hate speech.

    Este texto advoga que a análise dos instrumentos internacionais que regem o direito à liberdade de expressão e suas restrições afastam as melhores defesas do banimento à restrição imposta ao discurso de ódio. Para isso, estabelece a gênese da proteção à liberdade de expressão e avalia como os instrumentos internacionais universais e regionais interamericano e europeu a contemplam, esclarecendo seu conteúdo e as restrições que são impostas ao seu exercício. A pesquisa foi feita essencialmente em doutrina e nos instrumentos internacionais mencionados. A análise levou à conclusão de que o sistema interamericano é o mais protetivo da liberdade de expressão, ao mesmo tempo em que é mais modesto em relação às restrições que impõe ao exercício da liberdade de expressão. Ainda assim, há, no sistema interamericano, mecanismo que permite proteção adequada em face de abusos que possam ser praticados em nome da liberdade de expressão e que justifica a adoção de restrições como a do discurso de ódio.
