    Desde la visión del Estado liberal, la interpretación de la ley era impensable, ejemplo de ello se manifiesta en el desarrollo de la escuela de la exégesis. Pero la realidad se impuso a este planteamiento, y en la transición al Estado constitucional, el juez adquiere un papel fundamental en la creación del derecho y, ante cada decisión, se enfrenta a un problema. Así las cosas, la interpretación dentro del derecho ha tomado una importancia significativa anteriormente impensable. Surge además el planteamiento del pensamiento problemático del derecho. Ante ello, debemos enfrentar el problema de la interpretación constitucional desde una visión más amplia en cuanto a sus posibilidades, de lo contrario, la Constitución se convertirá en un documento obsoleto y alejado de la realidad social.

    From the perspective of the liberal state, the interpretation of the law was unthinkable, example of this is reflected in the development of the exegesis school. But reality has set in this approach, and the transition to Constitutional state, the judge takes a key role in the creation of law and, before every decision, is facing a problem. So, interpretation within the law has taken on significant importance previously unthinkable. Thus there is the approach of the problematic thinking of the law. To this, we must face the problem of constitutional interpretation from a broader view about their chances, otherwise, Constitution will become an obsolete document and distant from social reality.
