    If the invented is not susceptible of industrial application, there is no patent. Let's see when this test is due. Once it is established, the effect of art. 10, that the knowledge in question is a hypothesis patent incidence is up examination in the light of art. 15. Simultaneous or after the examination of industrial applicability, will be also verify if the knowledge is new for the purposes of art. 11. After this will be verified and the existence of minimum contribution, ie for inventions, inventive activity, according to art. 13; if it's utility model (defined according to art. 9), the inventive step defined by the axis of the functional improvement, according to art. 14. Finally, will be checking for any categorical rejection pursuant to art. 18, and are satisfied the requirements of Art. 24.

    Se o invento não é suscetível de aplicação industrial, não haverá patente. Vejamos quando esse teste é devido. Uma vez que se determine, por efeito do art. 10, que o conhecimento em questão constitui uma hipótese de incidência patentária, cabe exame sob a luz deste art. 15. Simultânea ou posteriormente ao exame de aplicabilidade industrial, verificar-se-á também se o conhecimento é novo, para os efeitos do art. 11. Após isso, verificar-se-á e existência de contributo mínimo, ou seja, para invenções, a atividade inventiva, na forma do art. 13; caso de trate de modelo de utilidade (definido segundo o art. 9º), o ato inventivo definido pelo eixo da melhoria funcional, segundo o art. 14. Enfim, verificar-se-á a existência de alguma rejeição categórica por força do art. 18, e se estão satisfeitos os requisitos do art. 24.
