    El derecho a circular y residir libremente en el territorio de la Unión, por interpretación de Tribunal de Justicia de la Unión Europea, se ha extendido a los familiares de los ciudadanos europeos. De esta manera, el Tribunal Supremo español reconoció el derecho de residencia, sin importar que los familiares tuvieran nacionalidades de países que no son miembros de la Unión. El objetivo de este artículo es, por un lado, conocer el desarrollo de la jurisprudencia del TJUE en materia relativa a los derechos de los ciudadanos de la Unión y de los miembros de su familia a circular y residir libremente en el territorio de los Estados miembros cuando el familiar extranjero cuente con antecedentes penales y, por otro lado, analizar el efecto que las sentencias de 13 de septiembre de 2016, Rendón Marín, as. C-165/14 del TJUE y del 10 de enero de 2017 del Tribunal Supremo español han tenido sobre las actuaciones de la Administración pública nacional.     The European Court of Justice granted the right to move and reside freely within the territory of the Union to the relatives of the European citizens. In the same manner, the Spanish Supreme Court awarded the right of residence to relatives of European citizens, regardless if they are nationals of countries that are not member States of the Union. This paper intends, on the one hand, to reveal the development of the jurisprudence on the right of European Union citizens and their family members to move and reside freely within the territory of the Union and, on the other hand, it aims to examine the effects that the rulings on this issue of the Court of Justice of the European Union (cjeu) and of the Spanish High Court have had on the actions of the national Public Administration. The research focuses on the particular case of a foreigner with criminal records
