    The Brazilian Constitution of 1988 also protects cultural heritage material and immaterial nature that are carriers of the references to groups that make up our society. In this sense, the Brazilian legislation established the record of the intangible cultural heritage as a legal instrument to safeguard cultural property. However, at the federal level, the Federal Executive Branch did not foresee the recognition of the Masters of Culture Living Human Treasures or. Conversely, many laws of Brazilian states recognized the importance of traditional knowledge of these transmitters as such in other countries. Thus, this article aims to analyze and describe the laws of the Brazilian states governing the protection of the living treasures, especially the Ceará standards, aiming to provide support to existing legal proposals at national level.

    A Constituição brasileira de 1988 protege igualmente os bens culturais de natureza material e imaterial que são portadores das referências aos grupos que constituem nossa sociedade. Nesse sentido, a legislação brasileira estabeleceu o registro do patrimônio cultural imaterial como instrumento legal de salvaguarda de bens culturais. Porém, no âmbito federal, o Poder Executivo Federal não previu o reconhecimento dos Mestres da Cultura ou Tesouros Humanos Vivos. Em sentido oposto, muitas leis dos Estados brasileiros reconheceram a importância desses transmissores de conhecimentos tradicionais tal qual em outros países do mundo. Assim, o presente artigo tem por objetivo analisar e descrever as leis dos estados brasileiros que disciplinam a salvaguarda dos tesouros vivos, com destaque para as normas cearenses, com intuito de fornecer subsídios a propostas legais existentes no plano nacional.
