    El propósito de este trabajo es hacer un comentario crítico a la sentencia del Tribunal Constitucional (TC) que resuelve el primero de los recursos de inconstitucionalidad planteados contra la Ley de Garantía de la Unidad de Mercado (LGUM). En primer lugar, se explica someramente el contenido sustantivo de la LGUM. En segundo lugar, se pone al descubierto la nueva doctrina sobre la unidad de mercado que el autor ve en la sentencia. En tercer lugar, se examina la respuesta dada por el TC a las impugnaciones planteadas contra los dos pilares de la ley. En especial, el autor escruta críticamente la fundamentación del TC que le lleva a declarar inconstitucionales y anular los preceptos de la ley relativos al llamado «principio de eficacia nacional». El trabajo concluye con unas breves reflexiones.

    The purpose of this paper is to make a critical review of the Spanish Constitutional Court’s (TC) Judgment that solves the first appeal filed against the Spanish Law on the Guarantee of Market Unity (LGUM). On the first hand, the substantive content of the LGUM is briefly explained. On the second hand, the author unveils the new doctrine held by the Constitutional Court in the judgment. Finally, the author examines the answer given by the TC to the challenges raised against the law’s two pillars. In particular, the author scrutinizes in a critical way the arguments of the TC that leads him to declare unconstitutional and annul the provisions of the law relating to the so-called “principle of national effectiveness”. The work concludes with some brief reflections.
