    The study presented here sought to make the analysis of the institute of social function applied to copyright , in order to verify if this institute acts to materialize the constitutional goal of building a caring society . The research is justified because of the development on the one hand, of the so-called " information society " , which is characterized by wide demand developed by society in persecution of information and knowledge , and on the other hand, given the necessary attention to economic and moral rights of the author of intellectual works . The method of approach used was the hypothetical -deductive , because that is hypothesized that the institute of social function meets the constitutional order revealed by the positiveness of the principle of solidarity. It appears that there is a logical link between the requirement that the property portrayed in the author's economic rights comply with its social function and the constitutional objective of building a free, fair and solidary society, since in both cases it is to adopt an attitude focused on serving the social interests at the expense of exclusive attention to the interests and property of the individual author

    O estudo ora apresentado buscou efetuar a análise do instituto da função social aplicada ao direito de autor, de forma a verificar se tal instituto atua no sentido de materializar o objetivo constitucional de construção de uma sociedade solidária. A pesquisa realizada se justifica em razão do desenvolvimento, por um lado, da chamada “sociedade da informação”, a qual se caracteriza pela ampla demanda desenvolvida pela sociedade em busca de informação e conhecimento, e de outro lado, em razão da necessária atenção aos direitos morais e patrimoniais do autor das obras intelectuais. O método de abordagem utilizado foi o hipotético-dedutivo, em razão de que se partiu da hipótese de que o instituto da função social atenda ao objetivo constitucional revelado através da positivação do princípio da solidariedade. Verifica-se que há uma vinculação lógica entre a exigência de que a propriedade, retratada no direito patrimonial do autor, atenda a sua função social e o objetivo constitucional de construção de uma sociedade livre, justa e solidária, posto que em ambos os casos se está a adotar uma postura voltada ao atendimento dos interesses sociais em detrimento da atenção exclusiva aos interesses patrimoniais e individuais do autor.
