¿Qué es la Seguridad Pública para México? Gendarmería y Proximidad Social como estrategias policiales

    Desde 1994 la Constitución Política de México incluye la frase “seguridad pública” en el artículo 21; sin embargo, el legislador no define con precisión lo que ésta significa, o cuál es su cuerpo ejecutor. Tampoco queda clara su naturaleza, pues al estar incluida en el capítulo “De los Derechos Humanos y sus garantías”, el dilema surge en interpretar si es un Derecho Humano para México o representa una garantía de los Derechos Humanos. Al respecto, el Poder Judicial Federal hasta ahora ha sido omiso. El último recurso de interpretación es el doctrinal, en donde se abordan algunas definiciones de autores mexicanos, logrando así una noción de qué debemos entender por seguridad pública. Finalmente, este artículo analiza la labor del Poder Ejecutivo Federal en cuanto a la instrumentación de dos estrategias policiales, la Gendarmería y Proximidad Social, mismas que aunque adversariales, teóricamente México las ha fusionado en un mismo cuerpo policial.

    Since 1994 the Mexican Constitution includes the phrase “public security” in article 21, however, the legislature does not define precisely what it means, or what is its executing body, especially that its nature is not clear either, that is to say Being imbued in the chapter “On Human Rights and its Guarantees”, the dilemma arises in interpreting, if it is a Human Right for Mexico, or represents a guarantee for these, work in which the Federal Judicial Power has been ignored. The last resort is the doctrinal one, where some definitions of Mexican authors are approached, obtaining, thus, a notion of which is the public security. Finally, the work of the Federal Executive Branch is analyzed in terms of the implementation of two police strategies, the Gendarmerie and Social Proximity, which although theoretically opposed Mexico has merged into the same police force.
