    El papel de la Agencia para la Defensa Jurídica y Patrimonial del Estado no ha terminado por reglamentarse a plenitud en Colombia. A pesar de ser crucial, los estamentos descentralizados y nacionales han pasado por alto este suceso. El análisis institucional brinda elementos para articular las pretensiones de la agencia con la capacidad orgánica del Estado colombiano para responder a este reto. El Estado debe evaluar sus fines y funciones conforme a las pretensiones de la agencia. De paso, el análisis institucional imprime en la estructura estatal la posibilidad de consolidar los parámetros de dicha agencia, para finalmente, determinar en el marco de la responsabilidad del Estado dicho margen de acción. El Estado debe incorporar la defensa jurídica, pero sin descuidar sus compromisos.

    The role of the Agency for the Legal and Patrimonial Defense of the State has not been fully regulated in Colombia, despite being crucial, because decentralized and national instances have missed this event. Institutional analysis provides elements to articulate the claims of the agency with the organizational capacity of the Colombian State to meet this challenge. The State should assess its purposes and functions according to the claims of the agency. Incidentally, institutional analysis opens in the State structure the opportunity to consolidate the parameters of the agency, to finally print on the accountability framework of the State such leeway. The State must include legal defense, but without neglecting their commitments.
