    Este comentario pretende dar cuenta de los problemas que ha tenido la codificación (incluyendo la chilena) y, en consecuencia,la doctrina y la jurisprudencia en la configuración de la naturaleza y en la justificación de los intereses en el contexto delos préstamos de consumo. En este caso, la Corte Suprema, pretendiendo ofrecer una explicación basada en construcciones propias de la lógica dominical, inadvierte las dificultades que ha conllevado una formulación económica con un complejo encuadre en el plano legal. Y, con ello, entorpece la concreción del régimen jurídico delos intereses, los que deben ser observados desde la dinámica obligacional como el objeto de un crédito diverso, aunque dependiente,de aquél que pretende la restitución del capital.

    This commentary aims to evidence the problems that the codification (including the Chilean code), and, consequently, the doctrine and the jurisprudence, have in the identification of the legal nature and the justification of interests in the context of loans. In this case, the Chilean Supreme Court, trying to offer an explanation based on a property-related logic, ignores the difficulties of an economic formulation with a complex legal framework. And, therefore, hinders the concretion of the legal regime of interests, which must be observed from the perspective of the obligations, as the object of a diverse, albeit dependent, claim than the one that seeks the restitution of the principal.
