    El principio iura novit curia en materia de responsabilidad del Estado ha tenido un desarrollo principalmente jurisprudencial en nuestro país, aplicándose con el fin de garantizar el acceso a la justicia y la primacía de lo sustancial sobre las formalidades en los eventos en que existe divergencia entre el título de imputación que quienes pretenden obtener del Estado la reparación de un daño invocan en la demanda con el que efectivamente se deriva de los hechos demostrados. Mediante esta revisión bibliográfica, y en uso del método analítico-documental, encontraremos cuáles son los límites a que debe ceñirse el juez al aplicar este principio y la forma como este se desarrolla en la responsabilidad contractual y extracontractual del Estado.

    The iura novit curia tenet in matters of responsability of State, has had a mainly jurisprudential development in our country, applying with the purpose to guarantee the access to justice, and the primacy of the substance over the formalities in case of divergence between the imputation title that invoques the people who intend to obtain from the State the reparation of a damage and the imputation title that results demonstrated from the facts. Through this bibliographic review article, and using the analytical-documentary method, we’ll find what are the limits to which the jude must adhere at the moment to apply this tenet, and the way it develops in matters of contractual and extra-contractual responsability of the State.
