La conflictividad laboral en el Sector Público presenta características especiales precisamente por la convivencia en este sector de dos tipos de trabajadores, los funcionarios públicos y el personal laboral al servicio del mismo. A pesar de que el Estatuto Básico del Empleado Público (EBEP, en adelante), desde sus inicios, trató de establecer un régimen jurídico laboral unitario para ambos colectivos de trabajadores, en lo referente a la negociación colectiva y, por ende, la solución de conflictos, separa dichos regímenes, regulando tan sólo lo relativo al personal funcionario y estableciendo, por tanto, la regla de la aplicación de la legislación laboral al personal en régimen laboral.
Sin embargo, los límites que el citado Estatuto impone a los Pactos y Acuerdos adoptados en el ámbito de la negociación colectiva de los funcionarios se extienden, por imperativo legal, al resto de los empleados públicos, generando importantes dudas sobre el régimen jurídico aplicable, especialmente, al personal laboral.
Labor conflicts in the Public Sector presents special characteristics precisely because of the coexistence in this sector of two types of workers, civil servants and the labor contract workers. Although the Basic Statute of the Public Employee tried to establish an unitary labor legal regime for both groups of workers, in terms of collective bargaining and, therefore, the solution of conflicts, separates these regimes, regulating only what is related to the civil servant staff and establishing the rule of the application of the labor legislation to the workers in labor regime.
However, the limits that the Statute imposes to the Agreements adopted in the area of the civil servants collective bargaining, by legal imperative, are extended to the rest of the public employees, generating important doubts about the legal regime applicable, especially, to the staff.
