El artículo pretende profundizar, desde el Derecho español, en la naturaleza jurídica de los recintos confesionales católicos destinados a albergar columbarios, haciendo particular mención a la regulación de policía sanitaria mortuoria de la Comunidad Valenciana. Entre los objetivos se encuentra estudiar la posibilidad de su establecimiento, de su consideración civil o no de cementerio y la normativa aplicable.
Responde a la necesidad de aportar unas breves notas en torno a una cuestión en auge, la de la cremación, y más especialmente la del destino de las cenizas tras esta, hecho que cuenta con numerosos interrogantes.
The article investigates the legal nature of Catholic confessional enclosures for housing columbariums from the point of view of Spanish Law, with particular attention to mortuary health policing regulations in the Community of Valencia. The aims include the possibility or otherwise of using confessionals for this purpose, their civil status as a cemetery and the applicable law.
This responds to the need to provide some brief notes on an emerging issue, that of cremation and more particularly on the destination of the ashes, over which many questions are raised.
