    Se analiza en el presente estudio la relación entre la racionalidad en el proceso legislativo y la presunción de constitucionalidad de la ley penal. Esto, conforme con la hipótesis según la cual entre menor sea la racionalidad del proceso legislativo, menor será la presunción de constitucionalidad de la ley penal y, por ello, mayor habrá de ser el control de constitucionalidad que se realice sobre la misma.

    The relationship between rationality in the legislative process and the presumption of constitutionality of criminal law is considered in the present study. This, in accordance with the hypothesis that the smaller the rationality of the legislative process, the lower the presumption of constitutionality of the criminal law and, therefore, the greater the constitutionality control over the criminal law will have to be.
