Multas coercitivas a autoridades y funcionarios hostiles al cumplimiento de las sentencias

    Cuando la Administración no ejecuta voluntariamente el fallo judicial, entra en juego la ejecución forzosa. Y, para lograr la efectividad del fallo, pese a la renuencia, e incluso hostilidad de la Administración condenada, el legislador ha puesto en manos del juez variadas herramientas que le permiten, por un lado, actuar reemplazando a la Administración en las actuaciones que debe realizar en cumplimiento de una sentencia (p. ej., art. 108 de la LJCA). Pero también cuenta con mecanismos de compulsión para forzar que desde la propia Administración se cumpla lo ordenado. Estas últimas son medidas complementarias, indirectas, de ejecución. Entre ellas, constituye un eficaz instrumento la imposición de multas coercitivas a las autoridades y funcionarios que incumplan los mandamientos judiciales de ejecución.

    When the Administration does not voluntarily execute the judicial decision, forced execution comes into play. And, in order to achieve the effectiveness of the ruling, despite the reluctance and even hostility of the Administration, the legislator has put into the hands of the judge various tools that allow him, on the one hand, to act by replacing the Administration in the actions that must in compliance with a judgment (eg, article 108 of the LJCA). But it also has mechanisms of compulsion to force that from the Administration itself the order is fulfilled. The latter are supplementary, indirect execution measures. These include an effective instrument for the imposition of coercive fines on authorities and officials who fail to comply with judicial enforcement orders.
