Alcances de la ejecución del laudo arbitral

    En la ejecución del laudo arbitral, concurren dos situaciones para su ejecución: la que permite que los propios árbitros ejecuten el laudo y la que deja a los jueces ordinarios ingresar a la ejecución de los laudos. Es importante determinar si existen terceros afectados (basta la posibilidad) en el proceso arbitral. En un primer momento, la obligación de comunicar la presencia de terceros debe ser informado por cualquier de las partes, al Tribunal Arbitral. De tomar conocimiento el Tribunal Arbitral por algunas de las partes durante el desarrollo de la litis arbitral de la existencia de terceros, aquel de oficio debe requerir información sobre estos y podría incorporarlos de oficio, siempre con mucho tino y cautela a fin de no desvirtuar el proceso con la figura de partes no signatarias.

    In the execution of the arbitral award, there are two situations for its execution: the one that allows the arbitrators themselves to execute the award and the one that leaves the ordinary judges to enter the execution of the awards. It is important to determine if there are affected third parties (the possibility is enough) in the arbitration process. At first, the obligation to communicate the presence of third parties must be informed by any of the parties, the Arbitral Tribunal. If the Arbitral Tribunal is informed by some of the parties during the development of the arbitration litigation of the existence of third parties, that ex officio must request information about them and may incorporate them ex officio, always with great care and caution in order not to distort the process with the figure of non-signatory parties.
