    The general purpose of the present paper is to investigate the consequences on the shift of paradigm from human-machine to the human-information to the legal protection of the person, especially on the case of biopatents. To do so, bibliographic and documentary research method was used. As a main result, the article concludes that it is necessary to set the protection of human beings’ as a full value, not only as a subject of legal relations. That’s because the genetic information taken from a human being and placed in a database — separated from the body and completely unidentified — provides information about the human being and, therefore, is part of the human being.Keywords: information, law and technology, civil rights, industrial property, patents.

    O objetivo geral do artigo é investigar as consequências da mudança do paradigma do ser humano-máquina ao ser humano-informação para a proteção jurídica da pessoa, especialmente em face das biopatentes. O artigo utiliza como método a pesquisa bibliográfica e documental. Como principal resultado, verifica que é necessário buscar-se a proteção do ser humano como um valor integral, não só como um sujeito de relações jurídicas. Isso porque a informação genética retirada do ser humano e colocada em uma base de dados separada de seu corpo e completamente não identificada não deixa de conter informação sobre o ser humano e, portanto, é ser parte do ser humano.Palavras-chave: informação, direito e tecnologia, direitos civis, propriedade industrial, patentes.
