El fenómeno migratorio ilegal de los niños, niñas y adolescentes guatemaltecos que viajan sin compañía y el proceso de medidas de protección para su deportación

    La migración ha sido el fenómeno que ha afectado a la población mundial, desde épocas antiguas. Ha sido consecuencia de varios factores: guerras, enfermedad, persecución política, pobreza, intención de desarrollo integral y superación. Sin embargo, actualmente el fenómeno migratorio pone en evidencia las graves violaciones de los derechos humanos que sufren las personas en su país de origen y se convierten en migrantes.

    Los migrantes son personas vulnerables, por lo que se convierten en presas fáciles para las redes transnacionales de tráfico ilegal de migrantes, que forman parte grupos de delincuencia organizada, que lucran con la necesidad del migrante, poniendo en riesgo su vida.

    Es por ello el interés de los Estados en regularizar el proceso migratorio fortaleciendo sus fronteras, y se ha visto en el caso de Guatemala las masivas deportaciones de migrantes que ha recibido el país, tanto de adultos como de niños, niñas y adolescentes. Asimismo, se aprecia el interés de la Organización de las Naciones Unidas (ONU), en la creación de normativas de protección de los derechos de los migrantes, como la Convención de Palermo y sus protocolos, específicamente el Protocolo contra el Tráfico Ilícito de Migrantes, mediante la cual los Estados que lo han ratificado, se comprometen a respetar a los migrantes y están en la búsqueda de creación de acciones para lograr su correcta aplicación. En el caso de Guatemala, aún existe desconocimiento de su contenido y la forma de su aplicación, por lo que los migrantes son revictimizados y puestos en situaciones de mayor vulnerabilidad.

    Migration has been a phenomenon that has affected the world population since ancient times. It has been the result of: wars, diseases, political persecution, poverty, integral development and overcoming. However, the migration phenomenon today shows the serious violations of human rights suffered by people in their country and become migrants.

    Migrants are vulnerable people and they are easy prey for the smuggling of migrants, and the organized crime take advantage and profit from the migrant's need, putting their lives at risk.

    This is why every State has the interest in the regularization and legislation of the migration process, so they have been strengthening their borders. In the case of Guatemala, we have seen the massive deportations of migrants, both adults and children and adolescents. The United Nations Organization (UN) is also interested in creating regulations to protect the rights of migrants, such as the Convention in Palermo and its Protocols, Italy, in December 2000, specifically the Protocol against the Smuggling of Migrants by Land, Sea and Air, through which every Member State that ratify, commit themselves to respect the migrants and are seeking to create actions to achieve their correct implementation. In the case of Guatemala, there’s still a lack of knowledge about its content and the way its applied, that’s why migrants that have been deported are revictimized by the Guatemalan authorities.
