La justicia y la fuente moral del derecho, aproximaciones críticas a una cuestión filosófica

    El objetivo de este artículo es reflexionar en torno a la justicia y su relación con el Derecho sin prescindir del aspecto moral que debe unirse inextricablemente a los términos referidos. Por lo mismo, y de manera particular, hemos de considerar el concepto de justicia desde Platón y Aristóteles, pasando por algunos pensadores modernos y contemporáneos, y la relación de la misma con las actividades de la polis. Siendo así, la justicia la hemos de entender como la capacidad de ponerse en el lugar de otros individuos que sufren y que necesitan del compromiso moral de las personas al interior de una comunidad y donde son capaces de deliberar, por ello es menester afirmar que el ejercicio de la justicia necesita de la práctica de la deliberación.

    This article aims to reflect on justice and its relationship with the law, without eliminating the moral aspect that must be inextricably linked to the terms described. By the same token and particularly we need to consider the concept of justice from Plato and Aristotle through some modern and contemporary thinkers, and the relationship of it with the activities of the polis. And if so justice we have to understand it as the ability to take the place of other individuals who are suffering and who need the moral commitment of people into a community and which are capable of deliberating, so it is necessary to state that the exercise of justice needs the practice of deliberation.
