Casi un año después de que se destapase el escándalo Volkswagen, y siendo la incertidumbre la tónica que sigue predominando en los propietarios de vehículos equipados con el motor diésel EA 189 Euro 5 de Volkswagen, algunos se han aventurado ya en la batalla legal contra los concesionarios y la matriz Volkswagen A.G. con las más diversas pretensiones: la sustitución del vehículo por uno nuevo, la devolución del precio o la indemnización de daños y perjuicios, sin que por el momento exista una posición jurisprudencial uniforme al respecto. Este documento expone el origen del problema y recoge las decisiones judiciales adoptadas hasta el momento en España y Alemania, así como los problemas que están por venir y que dificultan que el consumidor recupere la confianza en la marca e impide que Volkswagen mantenga su nivel de producción e ingresos
Almost a year after the notice of violation of the American Clean Air Act by Volkswagen, the owners of such cars are still worried about the measures needed to adjust their cars’ engine diesel EA 185 Euro 5 to the requirements of the european legislation. Some of the customers have already entered into a legal battle against auto dealers and Volkswagen A.G., expecting to get a new car instead of the defective one, or asking for a compensation. The European courts have not reach yet a common position. This paper explains where the problem comes from and collects the judicial decisions issued by both Spanish and German courts, and the problems that are still to come and that make it hard for customers to trust Volkswagen again
