In a phenomenological approach, aims to clarify the importance of facts to the right answer. Proceeds comparing two referentials: the critical realism of Michele Taruffo and the Critical Hermeneutics of Law. In spite of its democratic common ground, there is a deep disagreement about what is meant by inter-subjective control of judgments. The conclusion drawn is to reject the “truth acquiring” structure of justice system as proposed by Taruffo.

    http://dx.doi.org/10.5007/2177-7055.2016v37n74p115Este trabalho trata da questão da verdade no Direito, mais especificamente: do status epistemológico do processo judicial. Em abordagem fenomenológica, neste artigo objetiva-se aclarar a relevância da apuração dos fatos para a resposta correta. Procede-se comparativamente entre dois referenciais: o realismo crítico de Michele Taruffo e a Crítica Hermenêutica do Direito. Constata-se sua aproximação democrática, mas uma profunda divergência quanto ao que se entende por controle intersubjetivo das decisões judiciais. Conclui-se rejeitando a estruturação “truth acquiring” do sistema de justiça nos termos propostos por Taruffo.
