    El presente artículo analiza jurídicamente el constitucionalismo de América Latina en relación con la incorporación doméstica del derecho internacional de los derechos humanos. Para ello, explora su evolución histórica y, además, elabora la distinción teórica entre la noción los derechos humanos y la de los derechos constitucionales, todo ello, tomando en consideración el contexto latinoamericano.

    También, se investiga el nivel de recepción de los derechos humanos en las diversas constituciones, así como las diversas técnicas jurídicas empleadas para dicha incorporación.

    Finalmente, el estudio analiza los efectos jurídicos que el tópico genera actualmente en el constitucionalismo de América Latina.

    This work analyzes the legal constitutionalism in Latin America in relation to domestic incorporation of international law of human rights. In this regard, this explores the historical legal development and it also elaborates the theoretical distinction between the notion of human rights and constitutional rights, considering the Latin American context. Also, it researches the level of reception of human rights in the various Latin American constitutions, as well as the various legal techniques used for such incorporation. Finally, this paper analyses the legal affects that this topic currently generates in the Latin American constitutionalism.
