Políticas habitacionales y la falta del derecho a la vivienda en Chile

    El siguiente trabajo analiza la historia de la vivienda social en Chile, como fi gura principal utilizada por los distintos gobiernos para intentar dar solución a los problemas habitacionales del país. A través de dicho análisis, se irá demostrando que la vivienda no ha sido entendida como un derecho social, sino como un bien de mercado absolutamente sujeto a la ley de la oferta y la demanda. Asimismo, se ahondará en las consecuencias negativas que ha tenido esta visión mercantilista, que van más allá del déficit habitacional cualitativo y cuantitativo con el que año a año deben luchar las administraciones de turno. Finalmente, se concluye la necesidad de cumplir con las obligaciones internacionales adquiridas por Chile, y dar a la vivienda la categoría de derecho fundamental, protegido por la Constitución.

    The following paper analyzes the history of social housing in Chile, as the main fi gure used by the governments trying to solve the housing problems of the country. Through this analysis, we will demonstrate that housing has not been understood as a social right, but as a market commodity, absolutely subject to the law of supply and demand. Also, we will deal with the negative consequences that this mercantilist view has had, consequences that go beyond the qualitative and quantitative housing defi cit with which every year must fi ght the government in power. Finally, we conclude that there is the need to comply with international obligations undertaken by Chile, and give the housing the status of a fundamental right protected by the Constitution.
