La discutible constitucionalidad de la instrucción de la dgrn 5-10-2010 sobre el régimen registral de la filiación de los nacidos por gestación de sustitución

    El presente estudio pretende analizar y explicar la incidencia de la Instrucción de la D.G.R.N. sobre el art. 10 de la L.T.R.H.A. (Ley Reproducción Humana) que permite la entrada en el Registro Civil Español de la inscripción de la filiación de un nacido en el extranjero, acudiendo los servicios de la gestación por alquiler (mujer que gesta y lleva a cabo el embarazo, para un tercero –pareja comitente- , lo que parece que vulnera la legislación sustantiva española (art. 10 de la Ley de Reproducción Humana).

    La citada Instrucción, objeto de estudio permite la posibilidad de la inscripción en el Registro Civil Español de un “nacido” en el extranjero, cuando el “contrato de gestación en útero ajeno se lleva a cabo conforme a la legislación del país que “no prohíbe este contrato”.

    The present study aims to analyze and explain the impact of the statements given by the D.G.R.N. concerning art. 10 of the L.T.R.H.A. (Law on Assisted Human Reproduction Techniques) that allows the entry of filiation registration of an individual born abroad into the Spanish Civil Registry using surrogacy services (a woman who gestates and carries a child full term for a third party- a committed couple), which appear to violate the existing Spanish legislation (article 10 of the Human Reproduction Law).

    The cited statement, which is the object of this study, allows the possibility of registering an individual born abroad into the Spanish Civil Registry when the contract of gestation in a surrogate uterus is held under the laws of the country that does “not prohibit this type of contract”.
