Cultura anti-constitucional y guerra en Colombia: La dictadura constituyente sin revolución democrática.

    En este escrito se plantea el reconocimiento autocritico del predominio en el siglo XX en Colombia de una cultura anti-constitucional en la que se consolidaron autenticas instituciones contrarias al constitucionalismo moderno. El modelo institucional analizado es la dictadura constituyente sin revolución democrática del General Rafael Reyes iniciada en 1905. Esta realidad socio-política y jurídica es objeto de un estudio comparado que logra identificar, primero, los grandes contrastes con la dictadura protagonizada por el contradictorio pero asombroso político y militar el Lord Protector de Inglaterra, Tomas Cromwell. Y, también, las diferencias con la victoria de Tomas Cipriano de Mosquera en la guerra de los Estados federados contra el gobierno autoritario de Mariano Ospina Rodríguez que concluyo con la promulgación de la Constitución de Rionegro de 1863. En segundo lugar, se constata la proximidad del mandato de Reyes con el arquetipo constituyente de Rafael Núñez cuando decreto la derogatoria de facto de la Constitución de los Estados Unidos de Colombia y convoco la Asamblea Nacional, integrada por unos delegados que el mismo designó, para que adoptara la Constitución de 1886 cuyas bases él, igualmente, había redactado. El estudio se apoya en las tesis sobre la contracultura constitucional o desconstitucionalizacion de P. Sagues por contraposición a la teoría de la Constitución como cultura de P. Haberle. Asimismo, en la concepción de cultura jurídica de G. Tarello y de institución, en perspectiva sociológica, de E. Durkheim.

    In this paper the self-critical recognition is discussed of autocratic dominance in the twentieth century in Colombia of an anti-constitutional culture in which genuine institutions contrary to modern constitutionalism are consolidated . The institutional model discussed and analyzed is the constituent dictatorship without democratic revolution of General Rafael Reyes begun in 1905. This socio-political and legal reality is the subject of a comparative study that can identify, first, the great contrasts with the dictatorship led by the contradictory but amazing politician and militarist the Lord Protector of England, Thomas Cromwell. And also, the differences with the victory of Tomas Cipriano de Mosquera in the war of the federal states against the authoritarian government of Mariano Ospina Rodriguez ended with the promulgation of the Constitution of Rionegro of 1863. Secondly, similarity is found with the mandate of Reyes with the constituent archetype of Rafael Nunez when he decreed the repeal de facto Constitution of the United States of Colombia and convened the National Convention of 1886, composed of some delegates that he himself to adopt the 1886 Constitution whose bases he had likewise drafted. The study is based on the thesis of the counter constitutional culture or deconstitutionalization of P. Sagues as opposed to the theory of the Constitution as a culture of P. Haberle. Also, the concept of legal culture of G. Tarello and of the institution, in a sociological perspective, of E. Durkheim.
