    El presente artículo estudia la evolución histórica de los conceptos de aguas y de bahías históricas, para luego entrar a analizarlos como excepción al artículo 10 de la Convención de las Naciones Unidas sobre el derecho del mar, de 1982. Asimismo, se determinan las condiciones y los requisitos necesarios para la existencia de este tipo de bahías. Para esto se analizan diferentes nociones, como las de costumbre internacional, los títulos históricos, la posesión efectiva, la aquiescencia, el factor tiempo y la prescripción en derecho  internacional  público.

    This article makes study of the historic evolution of the concept of the historic bays and waters. Then it makes an analysis of the concept as an exception of the article 10 of the 1982 United Nations Convention on the Law of the Sea. The article also determines the necessary conditions for the existence of this kind of bays; for this purpose it describes different concepts like international custom, historic titles, effective possession, acquiescence, the time factor and prescription on public international law.
