A força da fôrma: reflexões sobre linguagem jurídica e acesso à justiça nos juizados especiais federais do Espírito Santo

    This article is about the relationship between the teaching of law, professional practice and the possibilities of legal language for the extension or reduction of access to justice. The theoretical basis is the theory of Pierre Bourdieu’s fields and his critical approach on the role of language in the organization of the fields of fights for the symbolic capital. The conflicting basis of Bourdieu’s theory establishes the habitus as a means of balance of the conflicts within the social field. The habitus is the rule of organization of the field of vision (and division) of its members. In the legal field, the professionals demarcate their monopolized territories of actuation (spaces of power) from the field of language all their own. The understanding of a same language constitutes delimitations of spaces of power among legal practitioners (started) and profane (uninitiated) in the legal field, with serious repercussions on society. But the incorporation of habitus of the legal field starts in law school, where students understand the ideological hierarchy of the own field by the exercise of violence not perceived as will, from a training out of context and anachronistic, reproduced later in professional performance as naturalization of inequality and the inability of transformation of reality. The route will include methodological participant observation, to capture the expressional form of social actors in the set of hearings. Interviews were held with the attendees in Special Juvenile Federal Court of the Espírito Santo State, Brazil, for qualitative analyses about the perceptions of the parties involved in the process, in order to demonstrate the non- understanding of the public interviewed about the procedural process and the language used.

    Este artigo é sobre a relação entre o ensino do direito, a prática profissional e as possibilidades da linguagem jurídica para a ampliação ou redução do acesso à justiça. A base teórica é a teoria dos campos de Pierre Bourdieu e sua abordagem crítica sobre o papel da linguagem na organização do campo de lutas pelo capital simbólico. O fundamento conflituoso da teoria bourdieusiana estabelece o habitus como meio de equilíbrio dos conflitos dentro do campo social. O habitus é a regra de organização do campo de visão (e divisão) dos seus membros. No campo jurídico, os profissionais demarcam seus territórios monopolizados de atuação (espaços de poder) a partir do domínio da linguagem própria. O entendimento de uma mesma linguagem constitui delimitações de espaços de poder entre profissionais do direito (iniciados) e profanos (não iniciados) no campo jurídico, com repercussões graves na sociedade. Mas a incorporação do habitus do campo jurídico se inicia na faculdade de direito, onde os estudantes compreendem a hierarquização ideológica do próprio campo pelo exercício da violência não percebida como arbítrio, a partir de uma formação descontextualizada e anacrônica, reproduzida depois na atuação profissional como naturalização da desigualdade e da incapacidade de transformação da realidade. O percurso metodológico contemplará a observação participante, para captar a forma expressional dos atores sociais no cenário das audiências. Foram realizadas entrevistas com os atendidos no Juizado Especial Federal do Estado do Espírito Santo, Brasil, para análises qualitativas sobre as percepções das partes envolvidas no processo, de forma a demonstrar a (in)compreensão do público entrevistado sobre o trâmite processual e a linguagem utilizada.
