La problemática coordinación de la ayuda humanitaria de la Unión Europea

    El objetivo de este trabajo consiste en realizar una aproximación a la coordinación de las acciones de la Unión Europea en el ámbito de la ayuda humanitaria desde una perspectiva principalmente jurídico-internacional y práctica. Entre los factores que justifican esta investigación se encuentran: el aumento de las necesidades humanitarias causadas por catástrofes naturales o humanas y las limitaciones de los recursos necesarios para hacerles frente, unido al hecho de que la UE, a través de ECHO, y sus Estados miembros se han convertido en los principales donantes mundiales de ayuda humanitaria. En este contexto nos centramos en la coordinación de los numerosos sujetos y actores involucrados (Estados, organismos internacionales de Naciones Unidas y ONGs), así como en la compleja interacción de esta ayuda con otras acciones y políticas desarrolladas por la UE con finalidades conectadas en las mismas áreas geográficas, entre ellas, el mecanismo de protección civil europeo, la cooperación al desarrollo, los instrumentos de estabilidad y los crecientes recursos militares y de la defensa civil en el marco de la política exterior y de seguridad común. Esta conjunción de acciones de naturaleza diversa difumina en la práctica la obligación jurídica de aplicar los principios de Derecho internacional humanitario.

    The aim of this paper is to make an approach to the coordination of the European Union’s operations in the field of humanitarian aid, mainly from an international legal and practical perspective. The factors that justify the choice of this research are the increased in humanitarian needs caused by natural or man-made disasters and the limitations of resources to address them, together with the fact that the EU, through ECHO, and Member States have become the world's leading donors of humanitarian aid. Within this framework, we focus on the coordination of the different international subjects and actors (States, UN agencies and NGOs), as well as on the complex interaction of this aid with other actions and policies developed by the EU with link purposes in the same geographical areas, including the European civil protection mechanism, the development to cooperation, stability instruments and increased military and civil defense capacities in the context of the common foreign and security policy. This combination of various actions blurs the legal commitment to implement the humanitarian principles of international law.
