This paper analyzes the intellectual property from the social, civil and penal discipline, and the impact of intellectual piracy in Internet. It aims to clarify the legal treatment of the conduct of uploading and downloading, distinguishing those that are allowed. Those that are a civilly wrong and those that are criminal. We will distinguish between torts against the Intellectual Property Law and crimes against intellectual property; offerin g an accurate interpretation of concepts «intention of profiting» and «causing a loss». It is intended to give them a precise and restrictive meaning, as a way of distinguishing the activities that are crimes against intellectual property, and the ones that are only a violation of provisions of the Intellectual Property Law. In order to restrict the application of Criminal Law to the most serious cases of violation of intellectual property rights.
El presente artículo analiza la propiedad intelectual desde la disciplina social, civil y penal, y la repercusión o alcance de la piratería intelectual en Internet. Se pretende clarificar el tratamiento legal de las conductas de uploading y downloading, distinguiendo aquellas que son lícitas, aquellas que constituyan il ícito civil, y las conductas que son delictivas. Se insiste en la distinción entre ilícitos civiles contra la LPI y los delitos contra la propiedad intelectual; ofreciendo una interpretación ajustada de los conceptos de «ánimo de lucro» y «en perjuicio de terceros». Se trata de otorgarles un significado restrictivo con la finalidad de distinguir las conductas que constituyen un delito contra la propiedad intelectual, y las que son una infracción según lo previsto en la LPI. Todo ello para restringir la intervención penal a los casos más graves de vulneración de los derechos propiedad intelectual.
