Apuntes sobre la reforma constitucional en Bolivia

    El presente trabajo está dedicado a un examen sucinto de dos temas que, en materia constitucional, tienen íntima relación con la vigencia de un Estado de Derecho y el sistema democrático, tal como lo conciben instrumentos internacionales, en este caso la Carta Democrática Interamericana de 11 de septiembre de 2001, y con la reforma total de nuestra Ley Fundamental que culminó con la promulgación de la nueva Constitución Política del Estado (NCPE), el 7 de febrero de 2009. Sobre este último aspecto se exponen criterios sobre puntos concretos del texto constitucional tales como: el modelo de Estado, la división de poderes y órgano judicial, para llegar a la conclusión de que hay necesidad de ir a la reforma de la Constitución, teniendo en cuenta, fundamentalmente, las circunstancias irregulares que se dieron en su aprobación.

    This article�s concern is to study, briefly, two issues that in Constitutional Law have a close relation with the effectiveness of the Rule of Law and of the democratic system of government, as they are defined by the international law instrument, such as the Interamerican Democratic Charter of September 11, 2001. Both issues are related with the total reform of our Fundamental Law, which finalized with the enactment of the new Political Constitution of the State (NCPE, in Spanish). About the new Constitution, the articles analyses the model of State it proposes, the division of powers and the judiciary. Its conclusion is the necessity of modifying the Constitution, because of the non regular circumstances surrounding its approbation.
