    This paper makes a short analysis of informed consent in a medical and patient relation, when the right of the personality has a titular the incapable one. It is arisen quarrel on the consideration to be given to the manifestation of will of the legal representative and to the manifestation of will of the incapable one.

Levanta-se a discussão sobre a consideração a ser dada à manifestação de vontade do representante legal e à manifestação exteriorizada pelo incapaz.
