    Há tempos os direitos fundamentais têm ocupado lugar de proeminência no direito. Em razão disso, consolidou-se vasta doutrina acerca da temática direitos fundamentais. Contudo, o mesmo não se pode dizer quanto aos deveres fundamentais, que, ainda mais se comparado aos direitos fundamentais, possui doutrina incipiente acerca de sua fundamentação jurídica, aplicabilidade e validade. Este trabalho tem por objetivo a análise da eficácia jurídica dos deveres fundamentais e tem como ponto de partida a doutrina até aqui construída sobre o tema na seara dos direitos. Apesar de reconhecer-se a conexão funcional existente entre os direitos e os deveres fundamentais, o trabalho vai concluir que o ponto de partida não pode ser o ponto de chegada, de modo que os deveres fundamentais não podem seguir as mesmas regras que os direitos fundamentais, relativamente à sua eficácia jurídica, tendo em conta as diferenças existentes entre os dois institutos jurídico-constitucionais.

    There are times the fundamental rights have occupied prominent place on the right.

    As a result, vast doctrine was consolidated on the theme of fundamental rights.

    However, the same can not be said about the fundamental duties, which, even more compared to fundamental rights, has incipient doctrine about its legal rationale, applicability and validity.

    This paper aims at analyzing the legal effect of the fundamental duties and has as its starting point the doctrine hitherto built on the theme of the harvest rights.

    Despite the awareness of the existing functional connection between the fundamental rights and duties, the paper will complete the starting point can not be the point of arrival, so that the fundamental duties may not follow the same rules as the fundamental rights relating to their legal effectiveness, taking into account the differences between the two legal and constitutional institutions.
