    En el presente artículo se va a realizar una aproximación a los problemas jurídicos que se plantean en España en relación con la gestación por sustitución. Con este fin se va a abordar, en primer lugar, el tratamiento que el ordenamiento jurídico español realiza de esta figura, prestando especial atención a la situación de la mujer gestante, para posteriormente analizar una problemática concreta que se está planteando en España en relación con esta técnica reproductiva: la inscripción en el Registro Civil español, de los menores nacidos en el extranjero mediante gestación por sustitución. Para ello, se analizarán diferentes pronunciamientos de la DGRN y de órganos jurisdiccionales españoles, finalizando con un esquema argumentativo de los mismos.

    This article makes an approach to the legal problems raised in Spain in relation to gestational surrogacy. To this end it will address, first, the treatment that the Spanish legal system made of this figure, with particular attention to the situation of the gestational surrogate, later to analyze a specific problem that is being considered in Spain in relation to this reproductive technique: the inscription in the Spanish Civil Registration of children born through gestational surrogacy abroad.
