Seguridad en el mar, algunas implicaciones de los códigos IGS y PBIB

    La expedición del Código Internacional de Gestión de la Seguridad Marítima (Código IGS) y del Código de Protección de Buques e Instalaciones Portuarias (Código PBIB), en el contexto del Convenio SOLAS, tiene especiales implicaciones legales en diferentes figuras del derecho marítimo internacional, tales como la limitación de responsabilidad de los armadores de buques por reclamaciones marítimas, la limitación de responsabilidad de los armadores por contaminación por derrames de hidrocarburos, la limitación de responsabilidad del transportador marítimo de mercancías, la obligación del armador y del transportador marítimo en relación con la navegabilidad del buque, los contratos de fletamento y las coberturas de los Clubes de Protección e Indemnización. El presente artículo hace una descripción de las posibles consecuencias jurídicas que los citados códigos internacionales pueden tener respecto de cada una de estas instituciones y contratos.

    The expedition of the International Management Code of Marine Security and of the Code of Protection of Ships and Harbor Facilities, in the context of the SOLAS Agreement, has special legal implications in different figures in international and admiralty law, such as the limitation of liability of shipbuilders due to marine claims, the limitation of liability of shipbuilders due to contamination by oil spills, the limitation of liability of marine transporters due to merchandise, the shipbuilders and marine transporters duty related with the navigation ability of the ship, the contracts of chartering and the covers of P&I Clubs. The present article makes a description of the possible legal consequences that the mentioned international codes can have respect to each one of these institutions and contracts.
