Inmigración ilegal y trata de personas en la Unión Europea: la desprotección de las víctimas

    En la actualidad, la trata de personas es, entre todas las formas de delincuencia organizada, la actividad criminal de mayor crecimiento en la Unión Europea. La realidad que se esconde detrás de las redes que trafican con seres humanos no es otra que la maximización de beneficios económicos. Su complejidad dificulta que este fenómeno pueda afrontarse sólo con la intervención penal y policial. El presente artículo pretende abordar la problemática de la trata de personas y la inmigración irregular en Europa; y particularmente, la desprotección de las víctimas. En primera instancia, se perfila el marco genérico del tráfico de personas, estableciendo las diferencias existentes entre �tráfico irregular� y �trata de personas�; en segundo lugar, se analiza el tejido estructural de las mafias y redes organizadas; posteriormente, el impagable impulso de la ONU en la lucha contra esta lacra creciente, y la reacción insuficiente del Derecho comunitario y, a su sombra, la del Derecho interno; en tercer lugar, los déficit existentes en materia de protección de víctimas y testigos, y finalmente, se esbozan algunas propuestas de mejora.

    At the present time, the human trafficking is the most growing criminal activity in the European Union among the organized criminality. The real thing, behind the human trafficking networks, is the maximization of the economical profits. This problem is so complicated that is difficult to face it only with policy and penal actions. This paper tries to study the series of problems of human trafficking and irregular immigration in Europe; the analysis is essentially focused on the lack of protection that victims suffer. First, the author outlines the generic frame of human trafficking and defines the differences between «human trafficking» and «irregular migration». In second place, he analyses the structural network of the Mafias and organized criminality groups; then the author studies the invaluable impulse of the UNO against this growing blight, and also the insufficient reaction of the European and national law. In third place, Garcia Vazquez examines the existing deficits on protection of victims and witness. Finally the author proposes some solutions to improve the situation.
