    In 1808, Napoleon promised to regenerate the Spanish Monarchy without any rupture. He introduced a Constitution written upon the model of the Consulate and Imperial Constitutions which were the result of the 1789 revolution. This work intents to define what the Emperor meant by regeneration by studying both constitutional process and text. The question is analyzed according to the Spanish constitutional culture and differentiates the juridical meaning from the political meaning of the Constitution of Bayonne.

    En 1808, Napoléon promit de régénérer la Monarchie espagnole sans provoquer de rupture. Il introduisit une constitution préparée sur le modèle des textes du Consulat et de l'Empire et donc issue de la Révolution de 1789. Ce travail s'attache à définir ce que l'Empereur entendait par régénération à travers l'étude du processus constituant et du contenu du texte. La question est analysée en fonction de la culture constitutionnelle espagnole et distingue la portée juridique de la portée politique de la Constitution de Bayonne.
