    PROBLEMA: el poder de la Constitución y el constitucionalismo. OBJETIVO: describir el poder con relaciona a la Constitución y el constitucionalismo. MÉTODO: por medio de la síntesis para conocer ideas importantes sobre la problemática en este caso lo referente a la división de poderes. RESULTADOS: Es importante analizar uno de los elementos que hacen necesario la aplicación de un sistema constitucionalista en el Estado de Guatemala, su juventud e integración parcial, ya que a diferencia del sistema del Common Law que fue concebido en Inglaterra. CONCLUSIÓN: El constitucionalismo es un sistema que regula la forma de gobierno de un Estado que basa su ordenamiento en un texto constitucional, el cual es utilizado en sistemas de influencia romano-germánicos. El Common Law es un sistema de aplicación de justicia que basa sus estamentos en la costumbre y fallos anteriores, dando lugar a la creación de jurisprudencia abundante la cual debe ser estudiada para exponer el caso concreto dando pautas al juez del posible fallo logrando con ello una integración del sistema legal para sociedades de antigua creación que han evolucionado junto al mismo sistema.

    PROBLEM: the power of the Constitution and constitutionalism. OBJECTIVE: describe power as it relates to the Constitution and constitutionalism. METHOD: through synthesis to learn important ideas about the problem in this case regarding the division of powers. RESULTS: It is important to analyze one of the elements that make it necessary to apply a constitutional system in the State of Guatemala, its youth and partial integration, since unlike the Common Law system that was conceived in England. CONCLUSION: Constitutionalism is a system that regulates the form of government of a State that bases its order on a constitutional text, which is used in systems of Roman-Germanic influence. Common Law is a system of application of justice that bases its provisions on custom and previous rulings, giving rise to the creation of abundant jurisprudence which must be studied to present the specific case, giving guidelines to the judge of the possible ruling, thereby achieving a integration of the legal system for anciently created companies that have evolved alongside the same system.
