    Este artículo tiene por objeto estudiar la agravante de ensañamiento prevista en el artículo 12 número 4 del Código Penal chileno, consistente en «aumentar deliberadamente el mal del delito causando otros males innecesarios para su ejecución», para lo cual se analizarán sus características esenciales, los elementos que la constituyen y las relaciones que median entre esta y otras circunstancias semejantes, proponiendo diversas soluciones e interpretaciones para aquellos aspectos que parezcan confusos o carentes de un tratamiento adecuado por la doctrina y la jurisprudencia.

    This paper studies the aggravating circumstance of cruelty provided for in article 12 number 4 of the Chilean Criminal Law, consisting of “deliberately increasing the evil of the crime by causing other evils unnecessary for its execution”, for which purpose its essential characteristics, the elements that constitute it, and the relationships that mediate between this and other similar circumstances will be analyzed, proposing various solutions and interpretations for those aspects that seem confusing or lacking an adequate treatment by the doctrine and jurisprudence
