    El Tribunal Supremo ha dictado una nueva sentencia estableciendo una analogía entre la situación del menor nacido en el extranjero por gestación por sustitución adoptado en España por la madre de intención y la del menor adoptado internacionalmente, al permitir al primero modificar la mención del lugar de su nacimiento que consta en el Registro Civil español para sustituirla por su domicilio (de la madre de intención adoptante). El objetivo es averiguar, teniendo en cuenta la implantación progresiva del nuevo sistema registral, donde queda el derecho a la vida privada y familiar y a la identidad del menor, que puede ver cómo el sistema ampara ocultar situaciones relevantes sobre su origen, como la permisibilidad de la modificación de su lugar de nacimiento o la apertura del nuevo folio donde consta solo de su filiación adoptiva, obviando información sobre sus orígenes.

    The Supreme Court has issued a new ruling establishing an analogy between the situation of a minor born abroad through surrogacy adopted in Spain by the intended mother and that of a minor adopted internationally, by allowing the former to modify the mention of the place of birth that appears in the Spanish Civil Registry to replace it with his/her domicile (of the intended adoptive mother). The objective is to find out, taking into account the progressive implementation of the new registration system, where the right to private and family life and the identity of the minor remains, who can see how the system allow hiding relevant situations regarding their origin, such as the permissibility of the modification of their place of birth or the opening of the new register paper containing only their adoptive affiliation, ignoring information about their origins.
