    El Convenio Nro. 95 de la Organización Internacional del Trabajo (OIT) sobre la Protección del Salario (1949) establece un conjunto de garantías que resguardan la remuneración. Este estudio analiza tres de dichas garantías en el contexto de los contratos laborales suscritos por futbolistas profesionales en el fútbol ecuatoriano: igualdad, oportunidad e integridad.La vulneración de estas garantías constituye un problema jurídico clasificado como dispersión normativa, caracterizado por la coexistencia de múltiples criterios, mandatos y reglas provenientes de diversas fuentes, incluidas leyes, reglamentos, tratados internacionales y sentencias judiciales. Esta diversidad genera incertidumbre jurídica y vacía de contenido la institución de la remuneración, afectando su correcta interpretación y aplicación.Para abordar este problema, se propone una nueva Ley del Futbolista Profesional que asegure la protección y efectividad de las garantías mencionadas, cumpliendo su función de tutelar y garantizar el derecho a una remuneración justa y equitativa.El presente artículo replica la investigación realizada por Dotti Battel y Díaz Poveda (2024), titulada: La vulneración de garantías en la remuneración de los contratos laborales en el fútbol ecuatoriano.

    Convention No. 95 of the International Labor Organization (ILO) on the Protection of Wages (1949) establishes a set of guarantees that safeguard remuneration. This study analyzes three of these guarantees in the context of labor contracts signed by professional soccer players in Ecuadorian soccer: equality, opportunity and integrity.The violation of these guarantees constitutes a legal problem classified as normative dispersion, characterized by the coexistence of multiple criteria, mandates and rules from various sources, including laws, regulations, international treaties and court rulings. This diversity generates legal uncertainty and empties the institution of remuneration of its content, affecting its correct interpretation and application.To address this problem, a new Professional Football Player Law is proposed to ensure the protection and effectiveness of the aforementioned guarantees, fulfilling its function of protecting and guaranteeing the right to fair and equitable remuneration.This article replicates the research conducted by Dotti Battel and Díaz Poveda (2024), entitled: The violation of guarantees in the remuneration of labor contracts in Ecuadorian soccer.
