  El presente capítulo expone los resultados de una investigación de diseño teórico, analítico-sintético, basado en fundamentos que responden a la interrogante: ¿Qué es el Estado? Para dar respuesta se alcanzó el objetivo de definir el Estado en virtud de la Constitución Política del Perú de 1993. Concluimos que la definición de Estado cumple con los siguientes aspectos: Organización política, republicana, separación de poderes, soberanía, pueblo y territorio peruano, dichos componentes obedecen a los elementos básicos del Estado: Pueblo, territorio y poder. A su vez, la constitución no cumple el equilibrio de poderes, lo que causa la disputa entre el Poder Ejecutivo y Legislativo. Respecto a la soberanía, es limitada, ya que los tratados protegen los derechos, pero hay pobreza y corrupción, por ello, el gobierno republicano es crucial, aunque no se materialice plenamente.

  This chapter presents the results of a theoretical, analytical-synthetic design research, based on foundations that answer the question: What is the State? In response, the objective of defining the State was achieved by virtue of the Political Constitution of Peru of 1993. We conclude that the definition of State meets the following aspects: Political organization, republican, separation of powers, sovereignty, Peruvian people and territory, these components obey the basic elements of the State: People, territory and power. At the same time, the constitution does not comply with the balance of powers, which causes the dispute between the Executive and Legislative Powers. Regarding sovereignty, it is limited, since treaties protect rights, but there is poverty and corruption, therefore, the republican government is crucial, even if it does not fully materialize.
